CHESNUT, District Judge.

In this case the defendant was indicted by the Grand Jury for the District of Maryland on February 15, 1952 for violation of 8 U.S.C.A. § 180(a). Section 180(a) provides (in material part) as follows:

"(a) If any alien has been arrested and deported in pursuance of law, he shall be excluded from admission to the United States whether such deportation took place before or after March 4, 1929, and if he enters or attempts to enter...
