BOSLAUGH, Justice.

This is a suit for a declaratory judgment to determine the validity of a resolution of the council of the city of Lincoln.

The general demurrer of the National Bank of Commerce, and the separate general demurrer of the city of Lincoln, the mayor thereof, and members of the council to the amended petition of appellee were denied. They elected not to plead further and judgment was rendered as follows...
