1. It is contended by the plaintiff in error that the ruling of the court on the demurrers, on June 2, 1951, became the law of the case and adjudicated that the petition as then amended set out a cause of action. This suit as originally brought was for damages on account of a defect in a bridge allegedly caused by the failure of the defendant to keep the bridge in repair.
