This appeal involves only a factual situation.
Dandry, the plaintiff, on May 7, 1951, by informal written contract purchased from Herbert Cooper, Sr., defendant, a certain speedboat for the sum of $1,000. The purchaser paid $100 down and agreed to pay the balance of the price at the rate of $40 or more per month.
