This is a suit to try title to real estate under LSA-R.S. 13:5062, Act 38 of 1908, neither party being in possession of the real estate in dispute. The controversy involves three small lots, numbered 2887, 2888 and 2889, each including 400 square feet, claimed by defendant out of the NE¼ of SE¼ of Section 26, Township 10 South, Range 10 West, La. Meridan, the entirety of which is claimed by plaintiff.
