Plaintiff Rita Draws began a malpractice action on September 8, 1945, against Dr. Simon Levin. She has appealed from a judgment entered upon a directed verdict in favor of the defendant.

Miss Draws, who had enjoyed good health since childhood, developed symptoms of toxic goiter when she was about 26 years old. She consulted Dr. Stern, who sent her to Dr. Levin of Houghton, Michigan. He performed a thyroidectomy on October 19, 1939, at St. Joseph...
