The tragic accident which gave rise to this litigation occurred in the City of Miami on Northwest 27th Street, which is located in a residential area, at about Noon Sunday, August 10, 1947. A Railway Express Agency truck ran over a large cardboard box in which Michael and Damon Brabham were playing in or about the middle of 27th Street between 14th and 15th Avenues.
