By the indictment in this case it is alleged and charged that the defendant did escape from the Iowa State Penitentiary at Fort Madison, on the 25th day of May, 1951, in violation of section 745.1 of the Iowa Code of 1950, I.C.A. Case was tried to a jury and defendant found guilty of the crime of escape and was sentenced and committed to the Iowa State Penitentiary for a term of five years, to commence at the expiration of any present sentences.
