TERRELL, Justice.

Appellant was tried and convicted for assault with intent to commit murder in the second degree. He was sentenced to serve a term of twenty years in the state penitentiary and has appealed from that judgment.

It appears that appellant was arrested and taken into custody by two policemen in Lakeland for exceeding the speed limit. He was ordered to the police station but elected instead to speed down the street in another direction and was...
