Appeal from an order denying defendant's motion for judgment notwithstanding the verdict or for a new trial.

Plaintiff's intestate, Russell Ray TePoel, lost his life when hit by a truck driven by defendant. The accident occurred on a road commonly known as the Oslo Road which runs in a north-south direction from the village of Kasson. The road was 29 1/2 feet wide from shoulder to shoulder, with ditches approximately two feet deep
