Plaintiff, Lloyd A. Duffy, brought a suit in law against Louis M. Duffy, Duffy Tire Company, and United States Rubber Company. His claim for damages was based upon two counts: (1) in tort, and (2) on contract. The first two named defendants filed separate answers and conducted a separate defense.
