GRIMSON, Judge.

The defendant, Norman St. Croix, was convicted in the District Court of Burke County of the crime of operating a motor vehicle on the public highway while under the influence of intoxicating liquor. At the close of the state's case the defendant moved the court to advise the jury to return a verdict in this case for the acquittal of defendant and the dismissal of the case upon the ground of the insufficiency of the evidence.
