1. Under this record the court did not abuse its discretion in the first grant of a new trial. The evidence did not in any view demand a verdict for the defendant. On the contrary we are inclined to think that the evidence demanded a finding in favor of the plaintiff except as to the value of the property involved and the hire thereof.
