SIMMONS, Chief Justice.

This is an action for treble damages under the Emergency Price Control Act of 1942, 29 U.S.C.A. § 901 et seq. Issues were made and trial was had. At the close of plaintiff's case-in-chief, defendant moved for a directed verdict and an order dismissing the action. The trial court sustained the motion and dismissed the action. Plaintiff appeals. We affirm the judgment of the trial court.
