Plaintiff Leon E. Reardon was injured when the automobile he was driving collided with one being driven by defendant Harold Buck at or near the intersection of West Michigan avenue (US-12) and Wildwood Avenue road west of the city of Jackson.

The first trial before the court without a jury resulted in a judgment of no cause of action in favor of defendant. A few days after the entry of that judgment, Reardon filed motions in arrest of the judgment...
