In August, 1949, the plaintiff (appellant) was the owner of a D-7 Caterpillar tractor, which he was using in logging operations. On August 28th a forest fire was reported in progress on West Mountain near Cascade, Idaho, and that men and equipment were wanted to fight the fire.
