Defendant, Clarence Curtis Smith, was arrested by an officer of the Pennsylvania State Police, and charged with violation of section 1218(d) of The Vehicle Code of May 1, 1929, P.L. 905, 75 PS § 783, as amended. The hearing before the justice of the peace was waived. Testimony has been taken before the court and the court makes the following
