C.C. Cooke commenced action and recovered judgment against Dan Tankersley on certain promissory notes and the defendant has appealed.

The notes had been executed in the name of the "Tankersley Construction Company," and signed "Tankersley Construction Company by Earl Tankersley," and "By Dan Tankersley" and indorsed by Earl Tankersley and the defendant in the same order.
