On November 2, 1951, plaintiff Baw filed this action, pursuant to § 503 of the Nationality Act of 1940, 8 U.S.C.A. § 903, for a judgment declaring him to be a national of the United States. His complaint alleges that he is a citizen of the United States and that the defendant Secretary of State unlawfully denied him a right and privilege as such by refusing to issue to him the necessary travel documents in order to travel from Hongkong...
