The defendant was tried in the Criminal Court of Record of Hillsborough County upon an information charging assault upon one Sonora Seward with a deadly weapon, to-wit, a pistol, and was found guilty of "assault with intent to commit murder in the second degree as charged in the information." Motion for new trial was denied. The defendant was adjudged guilty and sentenced to imprisonment in the State prison for a period of five years. From this judgment...
