This is an appeal from a summary judgment entered in a tort action instituted by appellants against appellees in the Circuit Court of Hillsborough County. The appellees filed their answer, which contained, among others, the defense of the statute of limitations; and, based upon such defense, the appellees filed a motion for summary judgment. The appellants thereupon filed a motion for leave to dismiss without prejudice, as authorized by 30 F.S.A...
