The object of this proceeding is to test the constitutionality of a portion of an Act of the General Assembly, chapter 345, Acts of Assembly 1942. The pertinent provisions of the Act read as follows:

"Section 1. The board of supervisors or other governing body of any county adjoining any city within this State having a population of more than one hundred ninety thousand, according to the latest preceding United States census, or any county...
