This is an appeal on questions of law from a judgment for the defendant, entered notwithstanding a verdict in favor of the plaintiff. Plaintiff's decedent had suffered from an asthmatic condition for some three or four years prior to his death. In January 1945 he was operated on for inguinal hernia and appendicitis.
