Plaintiff, a resident and taxpayer of the Town of Kure Beach, instituted this action to restrain the town from issuing municipal bonds for the acquisition and installation of water and sewer systems for the use and benefit of the town. Plaintiff alleged that the bonds if issued would not constitute valid obligations of the town.
