This appeal grows out of the passage of section 15, chapter 137 (H.F. 421) Acts of the 54th General Assembly, but it requires preliminary examination of Chapter 270, Acts of the 50th G.A. passed in 1943. At that time section 10837, code 1939, in a chapter entitled "Clerk of the District Court" provided:
