NULTY, Justice.

This action comes before us on exceptions by the plaintiff to the order of a nonsuit granted by the court at the October 1951 Term of the Kennebec County Superior Court. The action, by agreement, was tried before the court without a jury with right of exceptions reserved as to matters of law.
