This is a submitted controversy pursuant to section 546 of the Civil Practice Act. The question presented is whether a rent increase order made by the Temporary City Housing Rent Commission on August 20, 1948, has been rendered inoperative by virtue of the order of this court dated October 31, 1949, in Matter of Zarnes v. Finkelstein (275 App. Div. 1038).
