This case comes before us on an appeal from a judgment of a justice of the peace of Emporium, Pa., involving article VII, subsec. 5, of the Act of June 3, 1937, P.L. 1225, as amended, 34 PS § 1311.724(5). The facts, briefly, which have been agreed upon by both parties, are as follows: Defendant, James Milford Haynes, was arrested on a warrant issued by Sadie A.
