The defendant, Sam Harold Turvey, Jr., was charged by an information filed in the county court of Kay county with the offense of driving an automobile on the public highway while under the influence of intoxicating liquor. The jury by its verdict fixed his punishment at a fine of $500 and one year imprisonment in the county jail with a recommendation that the jail sentence be suspended.
