This is a compensation suit in which plaintiff claims permanent, total disability. Plaintiff also sought to recover 12% penalty and attorney's fees on the ground that defendant insurer "arbitrarily, capriciously and without probable cause, failed to make payment within sixty days after receipt of satisfactory proof * * *" in violation of LSA-R.S. 22:658. After trial there was judgment in favor of plaintiff and against the defendant employer and its insurer...
