SPRATLEY, Justice.

Walter J. Nee, fifty-three years of age, was struck and seriously injured by an automobile owned and driven by George Walter Whichard, defendant below. He brought this action against Whichard alleging that the accident was due to his negligence, and obtained a verdict and judgment against him, which Whichard seeks now to have reversed and a final judgment entered in his favor.
