Polk County sued Felix V. Howe and others in trespass to try title to several tracts of land lying northeast of the Brazos River in Baylor County and a small tract southwest of said river. The court instructed the jury to return a verdict for the defendants claiming the land northeast of the river and submitted the question of the true location of the southeast corner of the Polk County School Land Survey.
