This is an appeal from a final judgment in ejectment awarding damages to the plaintiff as "mesne profits." Upon plaintiff's motion for summary judgment, the trial court entered judgment in his favor on the question of title, and left the determination of damages for "mesne profits" to subsequent jury trial.

In their brief filed in this Court appellants say: "No question is raised in this appeal concerning the correctness of the judgment...
