Appellant, (hereafter referred to as plaintiff) filed a two count complaint against the appellee railroad company (hereafter referred to as defendant), the first count charging a violation of the Federal Boiler Inspection Act,1 and the second count charging negligence under the Federal Employers' Liability Act.
