This is an appeal from a judgment of the District Court of the United States for the Eastern District of Virginia, in favor of the defendant on his motion for a directed verdict. The action was instituted to recover damages for personal injuries sustained by the plaintiff as a result of an accident in which he was struck by defendant's automobile.
