GIBSON, Justice.

The parties will be referred to as they appeared in the trial court. Defendant in error was plaintiff, and commenced this action to quiet title to Lots 1 to 5, inclusive, in Block 8 of Lone Pine Addition to Idabel, Oklahoma, by filing his petition in the District Court of McCurtain County on June 11, 1947.
