R. E. Egerton, Sergeant of the city of Hopewell (hereinafter called defendant) has for some years occupied space in the basement of what is called the Municipal Building wherein he maintains his office. Because of the need of space to accommodate expanding municipal services, the Council of the city of Hopewell directed him to vacate his office and assigned to him office space at the city jail.
