In this suit the appellants, who were the plaintiffs below, filed a bill for declaratory judgment and other relief to impose a trust upon certain lands in Dade County.

It was alleged that W.V. Blackwell owned a certain tract of land and died intestate in 1930, when the property passed to his wife and four children. The taxes were not paid from 1930 until 1945, but no tax deed had been issued. There was a land boom in Dade County in 1944 and...
