This is an action to recover damages alleged to have been sustained by the plaintiff through the negligence of the defendant in driving his automobile upon and over the plaintiff as he was crossing a street in the City of Minot. The defendant makes general denial except he admits the accident. He pleads contributory negligence and that the plaintiff is not the real party in interest.
