This action was for the alleged wrongful death of Ray E. Cagle brought by appellant, his widow, Mrs. Marilyn Cagle, for herself and as guardian for their minor son, Danny Ray Cagle.

Mr. Cagle, a long time employee of McQueen and Stout, was a member of a drilling crew working in the drilling of a well for oil and gas for Gulf Oil Corporation. On June 11, 1949, an accident occurred which resulted in his death. While the drill bit and drill...
