This appeal comes before this court for review on a clerk's transcript. The defendant was charged with the crime of operating a motor vehicle upon the public highway while in an intoxicated condition in violation of § 321.281 of the 1950 Code of Iowa, I.C.A., and that said offense constituted the second offense for that he had previously been convicted on or about March 1, 1948 in the District Court of Clay County of the offense of operating a motor...
