SIMMONS, Chief Justice.

In this action the trial court had, by decree which became final, declared that a trust existed in a "substantial part" of an estate. A declaration of trust was filed to which objections were made. The trial court held that the amount declared to be held in trust was in compliance with the decree; refused to remove the trustees; and made an allowance of attorney fees.
