COLLINS, J., delivered the opinion of the Court.

This is an appeal from a declaratory "judgment and decree" that a lease between the appellee, the Baltimore and Annapolis Railroad Company, (B. & A.), and the appellants, Harry Weinberg and Jeanette Weinberg, (the Weinbergs) became validly terminated on October 21, 1951, and all liability of the appellee for rent under the lease terminated on that date.
