This is an action brought by plaintiff for and on behalf of Henry C. Bernard, under § 3 of the Railway Labor Act, 45 U.S.C.A. § 153, to enforce an order of the National Railroad Adjustment Board directing defendant to return Bernard to his former position as a Pullman porter. The trial judge held that Bernard's discharge was invalid by reason of violations of a collective bargaining agreement, and entered judgment in favor of plaintiff...
