Plaintiff, a judgment creditor, has attached the pension of defendant. The Pennsylvania Railroad Company was summoned as garnishee. Defendant is now a citizen of Florida; the judgment upon which the attachment was made was recovered against defendant in the Circuit Court of Hillsborough County, Florida.

Defendant qualified for participation in the pension plan on June 1, 1938. First payment was made to him
