RUDOLPH, Judge.

The information charged defendant, Arthur Goff, with shooting Maynard New-comb with intent to kill. The jury found him guilty of the included offense of shooting with intent to do bodily harm. The defendant has appealed from the judgment and from an order denying his motion for a new trial. We affirm the judgment and order denying a new trial.
