The Workmen's Compensation Bureau awarded petitioner partial permanent disability of 5% of total for a back injury allegedly caused by an accident arising out of and in the course of his employment with respondent on November 30, 1949. The Sussex County Court sustained the award on appeal. Respondent now appeals from the judgment of affirmance.
