POWELL, J.

The defendant, Levi Franklin Mandrell, was charged in the county court of McIntosh county with the offense of driving a motor vehicle while under the influence of intoxicating liquor. He was tried, convicted by a jury, his punishment fixed at a fine of $250, and he has appealed.
