The defendant, William Carroll Robertson, was charged by an information filed in the county court of Lincoln county with the offense of driving an automobile on the public highway while under the influence of intoxicating liquor; was tried; convicted; and sentenced to serve 30 days in the county jail and pay a fine of $300, and has appealed.

The prosecution was instituted as a result of a collision between defendant's automobile and a Greyhound bus...
