Appeal from a judgment entered upon findings of fact and conclusions of law of the trial court in favor of defendant.

The facts are not in dispute. On November 23, 1935, Louis Fearing and Lillian Fearing, his wife, who were the owners as joint tenants of a 120-acre tract of land in Todd county which they occupied as their homestead, conveyed the same by warranty deed to defendant, who is their nephew.
